NOTICE OF PUBLIC HEARING
FOR PROPOSED REVISIONS TO THE HAZARDOUS WASTE PROGRAM
DIVISION 335-14, ADEM ADMINISTRATIVE CODE

Notice is hereby given that a hearing before the Department of Environmental Management of the State of Alabama will be held on Tuesday, January 24, 2023, at 2:00 pm for the Division 14 Hearing, to be held in the Main Hearing Room at the ADEM – Central Office location at 1400 Coliseum Boulevard in Montgomery, to consider proposed revisions to Division 335‑14 (Hazardous Waste Program) of the ADEM Administrative Code. 

Revisions to Division 14 are being proposed to adopt two newly codified and revised federal rules promulgated by EPA.  The first of these federal rules, Modernizing Ignitable Liquids Determinations,  updates the criteria for identifying ignitable hazardous waste and modernizes the test methods for making such identifications, many of which currently require the use of mercury thermometers.  The second of these federal rules, Conforming Changes to Canada-Specific Hazardous Waste Import-Export Recovery and Disposal Operations Codes, updates rules related to twelve hazardous waste import-export recovery and disposal operations between the United States and Canada, which are necessary to reflect changes to rules related to hazardous waste import-export recovery and disposal operations promulgated by Canada.  Additional modifications are also made to make general clarifications, to make typographical or grammatical changes, and to maintain equivalency with federal regulations.

The public hearing is being held to receive data, views, and arguments from interested persons regarding the proposed rules.  Attendance at the hearing is not necessary to present such data, views, arguments, or comments. The same may be submitted in writing but must be received by the Hearing Officer prior to 5:00 p.m. on Tuesday, January 24, 2023.
