FOR PROPOSED REVISIONS TO THE VOLUNTARY CLEANUP PROGRAM (VCP)
DIVISION 335-1 and 335-15, ADEM ADMINISTRATIVE CODE

Notice is hereby given that a hearing before the Department of Environmental Management of the State of Alabama will be held on Thursday, December 14, 2023, at 10:00 am for the Division 1 Hearing and 1:00 pm for the Division 15 Hearing, both to be held in the Main Hearing Room at the ADEM – Central Office location at 1400 Coliseum Boulevard in Montgomery, to consider proposed revisions to Division 335-1 (General Administration) and Division 335-15 (Voluntary Cleanup Program) of the ADEM Administrative Code.

Revisions to Division 1 of the Alabama Department of Environmental Management (ADEM) Administrative Code are being proposed to modify, delete and add forms required for the implementation of the Department’s rules and regulations.  Additional modifications are being proposed to restructure the Voluntary Cleanup Program fees outlined in Fee Schedule H.  Modifications are also proposed which deal with Title V emission fees.  These proposed changes would delete rules which were applicable only during the first few years of the fee requirements (1993-1997).  In addition, changes are being proposed to outdated provisions dealing with the annual determination of fee levels.  Also, revisions to the Division 15 Code are being proposed to enhance job creation and economic development in the State of Alabama along with complying with updated/revised state law.  This rulemaking provides a mechanism to implement a cleanup program which encourages applicants to voluntarily assess, cleanup, remediate, and provide for the productive reuse of brownfield sites in Alabama.

The public hearing is being held to receive data, views, and arguments from interested persons regarding the proposed rules.  Attendance at the hearing is not necessary to present such data, views, arguments, or comments. The same may be submitted in writing but must be received by the Hearing Officer prior to 5:00 p.m. on Thursday, December 14, 2023.
