Iowa Coalition Against Sexual Assault

Provides for discharge, educational, and workforce credits for defendants on probation.

Prohibits a court or presiding officer in a contested case from deferring to an agency interpretation of a statute or rule.

Increases the penalty for an assault committed by a person against whom a protective order is issued.

Modifies the process for investigating complaints against school employees and increases reporting.

Increases the penalty for the dissemination of obscene materials to minors.

Modifies current law related to harassment through use of visual depictions.

Expands definition of "sex act" and creates an enhanced penalty for second and subsequent violations (class D felony). 

Updates the Department of Inspections, Appeals, and Licensing's (DIAL) responsibilities, focusing on confidentiality and handling of dependent adult abuse cases.

Makes changes to HHS processes concerning adoption information sharing, dependent adult abuse, juvenile court records, and mandatory reporter training.

Makes changes to human trafficking convictions.

Adds grooming behavior to mandatory reporting to the Board of Educational Examiners.

Directs HHS to submit a Medicaid waiver request to provide coverage for certain inmates due to be released.

Makes numerous changes to state boards, commissions, committees, councils, and other state government entities.

Requires certain school districts to employ security personnel and authorizes school employees to be issued weapons permits.

Makes grooming a criminal offense.

Makes changes to the duties of the Iowa Secretary of State in regards to the address confidentiality program and the conduct of elections.

Charges Iowa Department of Education (DE) to oversee AEA operations and changes how AEAs are funded and operate.

Requires human growth and development courses to include instruction on pregnancy and fetal development.

Removes the annual cap on the amount of Real Estate Transfer Tax funds that can be transferred to the Housing Trust Fund.

Changes property tax assessment limitations for commercial child care facilities.  

Establishes the behavioral health service system.

Makes changes to organization, structure, and functions of state and local governments.

Appropriates $213.6 million from gambling revenues (Rebuild Iowa Infrastructure Fund, or RIIF) to various infrastructure projects in fiscal year 2025 (July 1, 2024-June 30, 2025).  

Proposes a constitutional amendment to set a flat rate for individual income taxes and to require two-thirds approval of both legislative chambers for increasing tax rates.

Makes several changes to combat human trafficking, including an annual stakeholder meeting to develop legislative proposals, increase in the statute of limitations for human trafficking of a minor, and allowing video depositions for human trafficking victims of any age.

Makes changes related to criminal law, including the disclosure of a defendant’s privileged records, no-contact orders, commencement limitations for certain sexual offenses, sexually predatory offenses, victim rights, discovery, post-conviction relief actions, criminal appeals, and pretrial bond amounts for certain felonies.

Repeals gender balance requirements for appointed local and state government boards, councils, commissions.

Expands definition of extortion to include a person who threatens to distribute or publish a photo or video of a person engaged in a sex act or unclothed, when the person knows consent was not given for the distribution. 

Modifies the definition of sexual exploitation of a minor to include visual depictions.

Expands Medicaid coverage for pregnant women and infants while adjusting the income eligibility levels.

Makes changes to administration of MOMS program.

Makes changes to certain HHS reporting requirements.

Requires a criminal defendant to issue a subpoena for documents and evidence through an application to the court.

Allows the Board of Education Examiners to investigate complaints related to licensed school employees having inappropriate relationships with students at any time.

The Governor's tax bill.

Adds a narrow window for waiving the civil statute of limitations (SOL) for childhood sexual assault to allow victims to receive compensation under a settlement with the Boy Scouts of America.

Appropriates $688.5 million for the Attorney General, Iowa Law Enforcement Academy and Departments of Corrections, Public Safety, Homeland Security and Emergency Management and Inspections, Appeals and Licensing ($19.2 million increase, or 2.9%).

Appropriates $216.2 million to the judicial branch (courts), an increase of $3.7 million.

Appropriates $2.2 billion for health and human services programs (including Medicaid) for the fiscal year beginning July 1, 2024 (FY 2025).  This is an increase of $63.1 million. 

Eliminates individual income tax.
